The NPPA claimed AstraZeneca failed to implement revised ceiling prices for stocks available in the market following notifications S.O. 644(E) dated March 2, 2016, and S.O. 1352(E) dated June 2, 2016. The authority alleged this resulted in overcharging during June and July 2016.

Consequently, the NPPA demanded recovery of the overcharged amount along with applicable interest. The company challenged the demand notice before the Delhi High Court in W.P.(C) 12314/2026.

Conditions of Stay

The court has stayed the operation of the demand notice subject to a specific financial condition. AstraZeneca is required to deposit 15% of the amount mentioned in the NPPA’s demand notice with the Registrar General of the Delhi High Court.
