Settlement Details

The proposed settlement includes a fund of $2,300,000.00. Lead Counsel has requested attorneys' fees of up to one-third plus interest of the settlement amount, reimbursement of expenses not exceeding $55,000, and service awards of up to $3,500 for the Lead Plaintiff and $2,500 for Plaintiff Nelson. The court will also decide whether to certify the action as a class action and dismiss it with prejudice.

Class Member Actions

Members of the Settlement Class must submit a Proof of Claim and Release Form to share in the distribution of the Net Settlement Fund. Forms must be submitted electronically or postmarked no later than July 1, 2026. Class members who wish to exclude themselves from the settlement must submit a request for exclusion by the same deadline. Objections to the settlement or fee requests must also be received by July 1, 2026.

The Claims Administrator, Strategic Claims Services, is available to assist class members in obtaining notices and submitting claims. The Settlement Hearing will be held before the Honorable Linda V. Parker at the United States District Court for the Eastern District of Michigan in Detroit, MI, though the court reserves the right to hold it telephonically.
